A Writ Petition filed by UNP leader Ranil Wickremesinghe seeking annulment of the recommendations of the Presidential Commission of Inquiry (PCoI) into Political Victimizations was yesterday fixed for support on March 30 by the Court of Appeal.
The petition was taken up before a Bench comprising Court of Appeal Justices Nissanka Bandula Karunaratne, M.T.M Lafar Tahir and D.M. Samarakoon.
Chairman of the Commission, Retired Supreme Court Judge Upali Abeyratne, members of the Commission Chandrasiri Jayathilake and Chandra Fernando, Secretary to the Commission and Secretary to the President have been named as respondents in the petition.
The petitioner states that he did not receive any charge sheet or complaint when he was summoned to the Commission. However, the petitioner points out that the report of the Commission of Inquiry into Political Revenge cites findings and recommendations against him.
The petition states that the manner in which the commission investigated is completely against the law and that they have acted in excess of their powers. The petitioner also contends that the Commission’s investigations, recommendations and findings are unconstitutional.Therefore, the petition seeks the issuance of a Writ Order nullifying the recommendations and findings of the Commission. The petition also seeks an Interim Order restraining action on the recommendations.
